Perry Cockerell practices general commercial and real estate litigation and is head of the firm's Bankruptcy Practice Group.? He has been with the firm since 1981 and has worked in both the Dallas and Fort Worth offices.? He primarily represents creditors in bankruptcy proceedings by pursuing or defending their claims, handling contested matters, adversary proceedings, prosecuting non-dischargeability claims and bankruptcy appeals.? He balances a bankruptcy practice with a general commercial litigation practice with an emphasis in real estate and title insurance defense.? He has litigated in the courts of appeals in Texas, the Texas Supreme Court and the Fifth Circuit Court of Appeals.? He has been board certified in Civil Trial Law by the Texas Board of Legal Specialization since 1992.? His experience in title litigation has resulted in important decisions for?the title insurance industry such as Skelton v. Washington Mutual Bank, F.A., 61 S.W.3d 56 (Tex. App. - Amarillo 2001, pet. denied) that affirmed a valid purchase money lien executed only by one spouse against a homestead claim of the other spouse; Cadle Company v. Harvey, 46 S.W.2d 282 (Tex. App. - Fort Worth 2001, pet. denied) that upheld a homestead claim over a judgment creditor lien and resulted in the recovery of legal fees in favor of the homeowner; and Chicago Title Ins. Co. v. Alford, 3 S.W. 3d 164 (Tex. App. - Eastland 1999, pet. denied) that reversed and rendered a jury verdict against a title insurer against claims that were outside the terms of the title insurance contract.? His commercial litigation experience has been?invaluable in?numerous appellate decisions such as Liberty Enterprises v. Moore Transportation Co., Inc., 690 S.W. 2d 570 (Tex. 1985) where he performed at all levels and obtained a reversal of the court of appeals' judgment and affirmance of the trial court's judgment holding that a special appearance was waived after a default judgment when the defendant agreed to a new trial.?? ?? From 1998 to 2000 he served as an Adjunct Professor at Texas Wesleyan University School of? Law where he taught Texas Pre-Trial Procedure and Trials and Appeals. ? Recent Significant Cases

Successful defense of insured purchaser of property against claim brought by Trustee in Chapter 7 under Section 549 of the Bankruptcy Code.? Case resulted in Trustee dismissing adversary proceeding and all claims against the client. Successful reversal of jury verdict and judgment against title insurer for extra-contractual claims made outside the terms of the title policy. Successful declaratory judgment action in favor of insured purchaser of a home under title policy against litigious judgment creditor of the previous owner.? Case resulted in title insuring recovering defense costs usually absorbed by title company in defense of their insured. Successful declaratory judgment by way of counterclaim against adjacent property owner seeking to claim adverse possession property.? Judgment in favor of insured. Successful defense of? homeowner against claim brought by roofing subcontractor successfully defeating limitations under the RCLA and homeowner recovering damages and legal fees. Successful defense of? home builder against claims brought under DTPA by difficult home buyer who refused to close but filed lis pendens to cloud the sale of the property. Successful defense of guarantor of promissory note whose collateral was sold by noteholder without notice under the UCC.? Case reversed and remanded and was dismissed by plaintiff. Successful defense of criminal defense attorney from claims brought by former client.? Case resulted in summary judgment in favor of attorney affirmed on appeal. Successful defense of restaurant owner against personal injury claim brought by customer after customer had exited premises and was walking on public street.? Case was affirmed on appeal. Community Service ? Mr. Cockerell has been the firm's main contact in actively engaging it in the local community to support the?armed forces and reserves through the Fort Worth Council of the Navy League.? He has served as President of the Fort Worth Council during two terms and currently serves as the Chairman of the Advisory Board that is composed of civic leaders and heads of major employers in the Dallas/Fort Worth metroplex.? He also serves as a Director and JAG officer of the Dallas Council of the Navy League.? He is the current President of the National Defense Industrial Association (NDIA) - Lone Star Chapter, a 700-member organization that supports numerous companies and defense contractors in the Dallas/Fort Worth metroplex.? The NDIA provides scholarships to ROTC students and other services to the defense industry through its speaker series. He has served over 20 years in the Navy Reserves and was recalled twice to active duty during Operation Desert Storm from 1990 to 1991 and during Operation Enduring Freedom from 2001 to 2003.? He currently holds the rank of Commander and actively drills once a month with the Navy. Mr. Cockerell has distinguished himself in the community through his pro bono work and has received the Private Attorney Involvement Award and the Practitioner of the Year award from West Texas Legal Services.??
