Lawyer Profile

Kenneth Chaiken was born in Falls Church, Virginia on October 28, 1963. He attended the University of Florida, where he graduated in 1985 with a Bachelor of Arts Degree. He returned to the Washington, D.C. area and attended the National Law Center at George Washington University. He graduated from law school in 1988, and was awarded the degree of Doctor of Jurisprudence at that time. Kenneth is a member of the State Bar of Texas and the Bar of the District of Columbia. He is a member of the Bars of the United States District Courts for Northern, Southern, Eastern and Western Districts of Texas and the United States Court of Appeals for the Fifth Circuit. He is also a member of the Dallas Bar Association, the Dallas Bar Foundation, and the Association of Trial Lawyers of America.

Kenneth came to Dallas after graduating from law school, beginning his practice in the local office of a large, national law firm, where he concentrated his practice in the area of business and commercial litigation, and real estate transactions. After several years at a mid-size Dallas firm, where his practice evolved into a true general civil trial practice, he decided to leave the traditional law firm environment, and to venture out on his own, eventually forming Chaiken & Chaiken, P.C. with his two brothers, thereby fulfilling a long time family "dream" (which some might call a nightmare) of having a family business! Kenneth is, of course, the oldest of the three brothers. ? Kenneth limits his practice to complex civil litigation matters. He is regularly involved in cases of all varieties. He represents individuals, families and businesses. He has successfully defended clients against non-meritorious multi-million dollar claims and he has successfully helped his clients recover multiple millions of dollars in cases he has prosecuted for them. Throughout his career as a trial lawyer, Kenneth has had the unique experience of litigating and trying complex cases in venues across Texas and elsewhere in the U.S. He has won many cases on behalf of Plaintiffs and Defendants alike. Some of his more notable cases have included the following successes:

1. verdict in favor of a landowner that challenged a city government and major league sports franchise's joint attempt to seize, for private development purposes, a large tract of land under the auspices of using that land for stadium parking; 2. multi-million dollar verdict in favor of an airline pilot who was wrongfully fired after exercising sound judgment in landing an aircraft instead of continuing the flight into dangerous, life-threatening weather conditions; 3. $50million verdict in favor of the family of a nursing home resident who died as a result of the facility's neglect (The National Law Journal reported that this was the 44th largest verdict of all cases tried in U.S. in 2001); 4.? multi-million dollar settlement for the family of an individual whose life insurance carrier unjustifiably refused, in bad faith, to pay the insurance benefits when he died; and, 5.? multi-million dollar verdict on behalf of a corporate executive who was wrongfully fired when he refused to breach a company ethics policy in handling a multi-million dollar transaction with a customer.

In recognition of his creative and aggressive style as a trial lawyer, Kenneth is frequently invited to speak on the topic of trial practice and strategy at attorney seminars throughout the country.

Kenneth and his wife are the proud parents of three great kids. Together they enjoy sports, traveling and clowning around.
