Lawyer Profile
Gary Lawson was formerly a department chairman of one of Dallas' largest law firms. After co-founding the Dallas Bar Association section on Employee Benefits and Executive Compensation, he went on to become that group's chairman. Later, he was selected to be the first chairman of the IRS Key District EP/EO Oversight Liaison Council, consisting of some 18 attorneys and actuaries representing the ten states in the Dallas Key District.
He was a Founding Director of two national charitable organizations, MediSend International and the Children's Hope Foundation. Today he still serves on MediSend's International Advisory Board, and is an active member of (i) the Dallas Bar's Employee Benefits/Executive Compensation Sections, (ii) the National Association of Public Pension Attorneys, (iii) the Computer Law Association, and (iv) the Association of Trial Lawyers of America.
Mr. Lawson has been a member of the College of the State Bar of Texas for many years (the College of the State Bar of Texas is a special bar organization designed to recognize exceptional annual dedication to higher-than-required levels of continuing legal education).
He assisted in drafting two amendments to the Texas constitution to afford greater protection to participants in Texas governmental pension plans.
Mr. Lawson is the author of numerous articles on pension and tax matters and has been cited in the United States Court of Appeals decision of Morse v. Stanley, 732 F.2d 1139 (2nd Cir. 1984). A frequent speaker before such groups as TEXPERS, the National League of Cities, Guns & Hoses, the State Bar of Texas and others, he has spoken on dozens of occasions across the United States. Mr. Lawson also served as an Observer and active participant in representing the interests of public pension funds during the Uniformed Law Commissioners development of the 1997 National Conference of Commissioners on Uniformed State Laws Development of the Uniform Management of Public Employee Retirement Systems Act.
Mr. Lawson has served as an expert witness before the United States Congress on pension and health matters as well as in several pension malpractice cases, including a recent $200M legal malpractice case. He successfully prosecuted a $1M legal malpractice case against an out of state law firm involving a Texas based ESOP. In 1999, Mr. Lawson was appointed by the U.S. Federal District Court for the Northern District of Ohio to help the Court select a neutral ERISA mediator for two consolidated ERISA class action lawsuits.
Gary Lawson, Eric G. Calhoun and Gus Fields obtained a final judgment for a public pension fund, defeating a challenge to an election that determined who could serve on the pension board, the methodology of voting for trustees and whether the ballot was misleading to voters. The case involved a dispute concerning the validity of the ballot, and the constitutionality of the election process.
Gary Lawson and Gus Fields successfully represented the Austin Police Pension System in Wisian v. Austin Police Pension System in District Court in Austin, TX.
Successfully defended the Dallas Police and Fire Pension System in both Fifth Circuit and in Opposition to Petition for Writ of Certiorari before the U.S. Supreme Court in Alma Faye Russell v City of Dallas and the Board of Trustees of the Firemen, Policemen and Fire Alarm Operators' Pension Fund of Dallas, TX October 1992.
